Fauré Le Page Maroquinier SAS and Fauré Le Page Paris SAS v Goyard ST-Honoré SAS Case C-412/24 – EXC0015219

L&T Associate Solicitor, Vanessa Pearson, discusses a preliminary ruling of the European Court of Justice which provides guidance on the interpretation of Article 3(1)(g) of Directive 2008/95/EC and the circumstances in which a number in a trade mark may be interpreted as deceptive.

The Court of Justice determined that a trade mark may be deceptive where it includes a number which the relevant public is likely to perceive as indicating a business’s year of establishment and this evokes long-standing know-how that does not in fact exist.
