IP Case Analysis: EU – When can stocking goods be an infringing use of a trade mark?

Advocate General Spielman affirmed that Article 10(3) of Directive (EU) 2015/2436, which refers to the stocking of goods as being an infringing use of a trade mark, applies to goods stocked in another member state from that where the registered trade mark rights subsist.
